The State conducting the investigation shall arrange for the read-out of the flight recorders without delay." Chapter 5.16 ensures this applies whatever the "State of Occurrence".

Jun 20, 2016 at 9:43 comment added Jan Hudec Can they be used only for accident investigation, or for incident investigation too? I believe it is the later, i.e. that investigators can (and do) come for the recorders after events like serious traffic conflicts even though all the planes landed safely, nobody was hurt and nothing damaged.
